These Terms and Conditions apply to this website and to transactions related to our products and services. You may also have obligations arising from additional agreements related to your relationship with us or any products or services you receive from us. If any provision of those additional agreements conflicts with the provisions of these Terms, the provisions of those additional agreements will prevail.<\/span><\/p>\n

2. Complaints and Incident Management Policy<\/strong><\/span><\/p>\n

GABRIENTUM works with leading national and international suppliers and courier companies to offer you the best products. To ensure we can resolve any issues with your order, it is essential to follow this claims protocol:<\/span><\/p>\n

2.1 Incidents in Transport<\/em><\/span><\/strong><\/p>\n

Upon receiving your package, it is the customer's responsibility to check the condition of the packaging.<\/span>
\nIf the package shows visible damage (damaged, wet or open box), you must sign the carrier's delivery note indicating \"DAMAGED\" or \"PENDING INSPECTION\".<\/span>
\nCritical deadline: You must notify us of any cosmetic damage or breakage caused during transport within 24 hours of receipt by emailing info@gabrientum.es. After this deadline, courier companies will not accept claims, and transport insurance will not cover the incident.<\/span><\/p>\n

2.2 Defective or Incorrect Products<\/em><\/span><\/strong><\/p>\n

If the product malfunctions or does not match the order, please send us an email attaching: Order number + Photograph of the shipping label affixed to the original package + Video or clear photos of the defect or the product received.<\/span>
\nImportant note: Do not throw away the original packaging or shipping labels until the issue is resolved, as they are essential for processing the claim with the supplier.<\/span><\/p>\n

2.3 Information on Dropshipping<\/em><\/span><\/strong><\/p>\n

By operating through direct shipping from our partner suppliers:<\/span>
\nDelivery times: The delivery times indicated are estimates. We are not responsible for delays caused by customs, transport strikes, or extreme weather conditions.<\/span>
\nDelivery address: It is the customer's responsibility to provide a correct and complete address. If the package is returned due to an \"incorrect address\" or \"recipient not present after several attempts,\" the customer will be responsible for the reshipping costs.<\/span><\/p>\n

3. Refund and Return Policy<\/strong><\/span><\/p>\n

3.1 Right of withdrawal of consumers (individuals)<\/em><\/strong><\/span><\/p>\n

According to current legislation, consumers have 14 calendar days to return a purchased product without needing to justify their decision to withdraw. The withdrawal period begins from the date of delivery or collection of the product, and the return shipping costs are the responsibility of the consumer.<\/span>
\nProducts delivered according to the consumer's specifications or customized items cannot be returned. Therefore, products made to the consumer's specifications (dimensions, model, etc.) are exempt from the right of withdrawal. Products can be returned with the option of an exchange or a full refund.<\/span>
\n3.2 Procedimiento sobre el derecho de desistimiento<\/em><\/strong><\/span><\/p>\n

Purchased products can be returned within 14 calendar days from the date of delivery or collection at the point of sale (\"Return Period\").<\/span><\/p>\n

The decision to return the product must be communicated unequivocally before the Return Period expires; otherwise, the consumer will lose the right of withdrawal.<\/span><\/p>\n

The return decision can be communicated by means of a written request sent by email to info@gabrientum.es, which must include the following information: full name of the consumer, telephone number, email address, the product you wish to return, the quantity, the date and delivery address of the product to the consumer or the date of collection at the point of sale.<\/span><\/p>\n

The consumer must return the product within a maximum period of 14 calendar days from the date of communication of the return decision.<\/span><\/p>\n

The physical return of the products within the aforementioned period can be carried out through transport\/courier\/postal companies.<\/span><\/p>\n

Direcci\u00f3n de Devoluci\u00f3n (Almac\u00e9n de Origen): <\/span>Debido a nuestra estructura log\u00edstica internacional utilizada, los productos se env\u00edan desde diferentes centros de distribuci\u00f3n europeos. En caso de ejercer su derecho de desistimiento, el Cliente deber\u00e1 devolver el producto obligatoriamente al almac\u00e9n de origen desde donde se realiz\u00f3 el env\u00edo inicial (por ejemplo Italia u otros almacenes internacionales). La direcci\u00f3n exacta de devoluci\u00f3n ser\u00e1 facilitada por nuestro servicio de atenci\u00f3n al cliente tras recibir la notificaci\u00f3n de desistimiento. No se aceptar\u00e1n devoluciones enviadas a nuestra sede social u otras oficinas administrativas que no coincidan con el almac\u00e9n log\u00edstico de expedici\u00f3n.<\/span><\/p>\n

The consumer will be responsible for the costs of returning the product. <\/span>El Cliente ser\u00e1 el \u00fanico responsable de contratar a un transportista cualificado, organizar la log\u00edstica y sufragar la totalidad de los costes de env\u00edo internacional de vuelta.<\/span><\/p>\n

Advertencia de costes elevados: Gran parte de los productos ofrecidos tienen dimensiones at\u00edpicas (superiores a 200 cm) – De acuerdo con el Art. 108.1 del Real Decreto Legislativo 1\/2007, le informamos de que, debido a las dimensiones excepcionales del paquete (mercanc\u00eda de gran longitud o \u00ablong goods\u00bb), el coste de la devoluci\u00f3n puede ser elevado. Se estima que el coste del transporte internacional puede oscilar entre 80 EUR y 250 EUR, , o incluso superar esa cifra dependiendo del transportista elegido, el destino y las dimensiones espec\u00edficas. Recomendamos consultar tarifas con agencias de transporte especializado antes de iniciar el proceso. El Vendedor no ofrece servicio de recogida ni soluciones de transporte para las devoluciones.<\/span><\/p>\n

Responsabilidad durante el trayecto: Seg\u00fan la normativa vigente, cuando el Cliente organiza el transporte, este asume toda la responsabilidad sobre la integridad del producto hasta su recepci\u00f3n f\u00edsica en nuestro almac\u00e9n. Cualquier p\u00e9rdida, rotura o deterioro ocurrido durante el transporte de devoluci\u00f3n ser\u00e1 responsabilidad exclusiva del Cliente y de su transportista.<\/span><\/p>\n

All returned products must be in the same condition as when received. Products that have suffered subsequent deterioration, or that show signs of moisture, scratches, chips, dents, mechanical impacts, paint, or adhesives will not be accepted.<\/span><\/p>\n

Embalaje obligatorio: Debido a la fragilidad de los productos de gran longitud frente a la flexi\u00f3n, los art\u00edculos debe devolverse en su embalaje original r\u00edgido o en un embalaje de protecci\u00f3n equivalente que garantice la inmovilidad total del producto<\/span>, con las etiquetas originales intactas y todos los documentos que acompa\u00f1aban a la entrega del producto.<\/span><\/p>\n

Procedimiento de Recepci\u00f3n en Almac\u00e9n: Todas las devoluciones de dimensiones at\u00edpicas ser\u00e1n inspeccionadas a su llegada. Si el embalaje presenta da\u00f1os externos visibles en el momento de la entrega por parte del transportista del Cliente, el Vendedor se reserva el derecho de rechazar el paquete o aceptarlo indicando \u00abreservas de examen\u00bb en el albar\u00e1n de entrega. Se informar\u00e1 al Cliente en un plazo de 48 horas para que pueda gestionar la reclamaci\u00f3n de da\u00f1os con su agencia de transporte.<\/span><\/p>\n

Si desiste de este contrato, se le reembolsar\u00e1n todos los pagos recibidos de usted por los productos pedidos y entregados, incluidos los gastos de entrega ordinarios<\/span> (con la excepci\u00f3n de los gastos adicionales resultantes de la elecci\u00f3n por su parte de una modalidad de entrega diferente a la modalidad menos costosa de entrega ordinaria que ofrezcamos). Los costes directos de la devoluci\u00f3n del producto (transporte desde el domicilio del cliente al almac\u00e9n de origen) correr\u00e1n \u00edntegramente a cargo del consumidor.<\/span><\/span><\/p>\n

If the consumer exercises the right of withdrawal, in accordance with current legislation, and requests a refund of the price, the amount received will be refunded using the same payment method used for the initial transaction, within a maximum period of 14 days from the date on which they were informed of their decision to withdraw.<\/span><\/p>\n

GABRIENTUM may postpone the refund until the date of receipt of the products subject to the sale or until the consumer proves the shipment of the products to the professional, considering the earliest date.<\/span><\/p>\n

3.3 Depreciation of returned goods<\/strong>\u00a0<\/span> \u00a0 \u00a0 \u00a0<\/em><\/span><\/p>\n

In accordance with current regulations (General Law for the Defense of Consumers and Users), the consumer will be responsible for the decrease in value of the goods resulting from handling them other than that necessary to establish their nature, characteristics or functioning. <\/span>In order for the user to be entitled to a full refund, the product must be returned in the same condition in which it was delivered. If the returned product shows signs of excessive use, damage, missing accessories, or is not returned in its original packaging, GABRIENTUM reserves the right to<\/span>deduct an amount from the total refund for depreciation (reconditioning, cleaning, or loss of commercial value) or r<\/span>reject the return if the product has been handled in such a way that it is not possible to resell it.<\/span>
